All items purchased from Healthchem Pharmacy are so purchased pursuant to a shipment contract. Risk of loss and title for such items pass to the purchaser upon delivery. Delivery shall be deemed to have taken place upon arrival of the goods at the delivery address. The purchaser assumes risk of loss and/or damage at the commencement of unloading of the items. In the event that the agents or employees of Healthchem Pharmacy assist with any unloading, unwrapping or installation of the items, this is done as a courtesy to the purchaser, and does not form part of the duties of Healthchem Pharmacy.
In the event that the purchaser should opt to collect the items, the purchaser shall assume all risk of loss or damage to the items upon payment. Healthchem Pharmacy, its employees, agents, affiliates and parents shall not be held liable for any loss or damage to the items, the property of the purchaser or the property of any third party during or after loading, irrespective of whether the purchaser is assisted by the agents and/or employees of Healthchem Pharmacy.
